La familia: nuevas tendencias

Abstract

Resumen El presente trabajo “Familia: Nueva Tendencia” explicita como se compone actualmente la FAMILIA y cuáles son los nuevos modelos; define el termino FAMILIA, y precisa –finalmente- si los nuevos modelos familiares son regulados por nuestro ordenamiento jurídico. Enmarcado en una investigación cualitativa-explorativa, desarrollada mediante investigación documental (periodística, doctrinal y de jurisprudencia) un marco de contenido que recorre la evolución histórica de la Institución Familiar, conceptualizaciones del término y su regulación en Nuestra Constitución Nacional. Luego, una clasificación de FAMILIA según su cultura y modelo existentes para especificar – finalmente- los cuatros modelos familiares más conocidos Monoparental, Ensamblada, Homoparental, Convivencial con sus regulaciones según el ordenamiento jurídico nacional. LA FAMILIA MONOPARENTAL como fenómeno social en constante crecimiento; LA FAMILIA ENSAMBLADA más conocida como la de “los míos los tuyos y los nuestros”; LA FAMILIA HOMOPARENTAL su problemática social y jurídica actual y CONVIVENCIAL aspectos personales y patrimoniales. La mejor política de proteger a la INSTITUCION FAMILIAR es reconociéndola tal cual es, con y en sus diversos matices, legislando normas y/o creando Instituciones que sean acorde con el contexto social, sin desnaturalizar las ya existentes. -Familia – Familia Nuclear – Familia Monoparental - Familia Ensamblada – Familia Homoparental – Convivencial- Abstract The present work "families: new trend" explicit how the FAMILY consist nowadays and which are the new model. It defines the term FAMILY, and precise -finally- if the new family models are regulated by our juridical ordinance. Framed in a qualitative - explorative investigation, developed by documental research (journalistic, doctrinal and jurisprudence) a frame of content that runs through the historical evolution of the family institution, conceptualizations of the term and its regulation in our national constitution. Then, a FAMILY classification according their culture and existing models to specify - finally - the four most popular family models monoparental, assembled, homoparental, coexistence with its regulations under the national juridical ordinance. The MONOPARENTAL FAMILY like social phenomenon in constant growth; the ASSAMBLED FAMILY best know as "yours, mine and ours"; the HOMOPARENTAL FAMILY his social and current legal issues; and COEXISTENCE personal and patrimonial aspects The best policy to protect the family institution is recognizing it as it is, and it various nuances, legislating standards and/or creating institutions that are consistent with the social context, without denaturalize the existing ones.
