La organización bicameral del Congreso argentino y la presunta dificultad contramayoritaria en las reglas de representación democrática

Abstract

El presente trabajo analiza los diferentes aspectos que definen el esquema bicameral del Congreso argentino, a partir de la regulación dispuesta por la Constitución nacional. Se propone, a partir de allí, una comprensión directa del argumento, planteado por autores locales y también estadounidenses, según el cual los alcances dados a la intervención del Senado hacen de éste una institución contramayoritaria de la representación democrática. Se examinará entonces cómo los arreglos institucionales vinculados con la integración de ambas cámaras, así como las reglas que les confieren sus respectivas atribuciones, otorgan plausibilidad a estas interpretaciones. Todo ello, aún cuando corresponda reconocer la necesidad de reservar la función del Senado en favor de la igual representación de las provincias y la Ciudad de Buenos Aires, en su calidad de sujetos primarios de las relaciones federales.

This paper analyzes the different aspects that define the bicameral scheme of the Argentine Congress, based on the regulation provided by the national Constitution. From there, a direct understanding of the argument, put forward by local and also American authors, is proposed, according to which the scope given to the intervention of the Senate makes it a counter-majoritarian institution of democratic representation. It will then examine how the institutional arrangements linked to the integration of both chambers, as well as the rules that confer their respective attributions, give plausibility to these interpretations. All of this, even when the need to reserve the function of the Senate in favor of the equal representation of the provinces and the City of Buenos Aires is recognized, in their capacity as primary subjects of federal relations.
