“Acceso a la Información Pública Ambiental en la Provincia de Santa Fe”

Abstract

El presente trabajo analizó la normativa vigente en materia de acceso a la información pública ambiental descrita en el ordenamiento jurídico internacional, nacional y de la jurisdicción de la Provincia de Santa Fe, ajustado en el análisis propio que ofrece la doctrina y la opinión de otros actores sociales que, con un enfoque cualititativo de alcance descriptivo, facilitó alcanzar el objetivo general de la investigación, que se basó en identificar y analizar cuál es el procedimiento alternativo que posee la ciudadanía santafesina para acceder a tal información, al no contar con normativa específica en la jurisdicción; incluyendo pues, la mirada particular de algunos referentes ambientalistas y legisladores. Así, se exploró la Ley General del Ambiente (Ley N.º 25.675), la Ley de Acceso a la Información Pública Ambiental (Ley N.º 25.831), la Ley de Acceso a la Información Pública (Ley N.º 27.275) y, además, la Ley Provincial de Medio Ambiente y Desarrollo Sustentable (Ley N.º 11.717) y el Decreto Provincial N.º 0692, que regula el mecanismo de acceso a la información pública. La tarea determinó la inexistencia de una ley provincial complementaria de la ley nacional junto a la demanda efectiva de una norma acorde a los nuevos tiempos, que deshaga la burocracia y permita ejercer plenamente un derecho tan importante para la ciudadanía. Por tanto, se obtuvo que todo santafesino habrá de valerse de la Ley de Presupuestos Mínimos para requerir información ambiental, complementada por otras disposiciones locales.

This work analyzed the current regulations regarding access to public environmental information described in the international and national legal system and the jurisdiction of the Province of Santa Fe, adjusted to the own analysis offered by the doctrine and the opinion of other actors that, with a qualitative approach of descriptive scope, facilitated achieving the general objective of the research, which was based on identifying and analyzing the alternative procedure that Santa Fe citizens have to access such information, as they do not have specific regulations in jurisdiction; including, therefore, the particular perspective of some environmentalists and legislators. Thus, the General Law of the Environment (Law No. 25,675), the Law of Access to Public Environmental Information (Law No. 25,831), the Law of Access to Public Information (Law No. 27,275) and, in addition, the Provincial Law of Environment and Sustainable Development (Law No. 11,717) and Provincial Decree No. 0692, which regulates the mechanism of access to public information. The task determined the nonexistence of a provincial law complementary to the national law along with the effective demand for a norm in accordance with the new times, which undoes bureaucracy and allows the full exercise of a right so important for citizens. Therefore, it was obtained that every Santa Fe resident will have to use the Minimum Budget Law to require environmental information, complemented by other local provisions.
