Incidencias en el derecho internacional privado argentino a 30 años de la reforma de la Constitución Nacional

Abstract

Las constituciones reflejan la cultura y tradición de cada país. No es sorprendente que la Constitución Nacional (CN) carezca de normas específicas de derecho internacional privado (DIPr). Esta ausencia no implica que las disposiciones en esa materia estén exentas del proceso de control y adecuación constitucional. La Constitución contiene principios y valores que las disposiciones de DIPr deben defender y respetar, como la tutela judicial efectiva y la igualdad, para evitar ser consideradas inconstitucionales. Cuando la CN se modifica, inevitablemente el DIPr se ve afectado. Las principales consecuencias de la reforma de 1994 en la disciplina están asociadas, por un lado, al reconocimiento de la jerarquía supralegal de los tratados en general y, por el otro, a la jerarquización con rango constitucional de un número importante de instrumentos internacionales de derechos humanos.

Constitutions reflect the culture and tradition of each country. It is not surprising that the National Constitution (NC) lacks specific norms of private international law (PIL). This absence does not imply that the provisions in this matter are exempt from the process of constitutional control and adaptation. The Constitution contains principles and values that the provisions of PIL must defend and respect, such as effective judicial protection and equality, to avoid being considered unconstitutional. When the NC is modified, PIL is inevitably affected. The main consequences of the 1994 reform in the discipline are associated, on the one hand, with the recognition of the supralegal hierarchy of treaties in general and, on the other, with the hierarchization with constitutional rank of a significant number of international human rights instruments.
