Resumen
El presente estudio abordó el impacto de las nuevas tecnologías, particularmente la inteligencia artificial, la automatización y el teletrabajo, en el ámbito del derecho laboral argentino. A través de un enfoque metodológico mixto, se investigaron las transformaciones en las dinámicas laborales y su relación con los Derechos Económicos, Sociales, Culturales y Ambientales, así como las implicancias normativas y sociales derivadas de estos cambios. El diseño no experimental y transversal permitió combinar técnicas de revisión exhaustiva de literatura, análisis de casos prácticos y entrevistas con expertos del ámbito jurídico y tecnológico.
Los resultados reflejaron que la adopción de estas tecnologías no solo redefinió las relaciones laborales tradicionales, sino que también planteó desafíos significativos para la protección de los derechos de los trabajadores, especialmente en áreas como la estabilidad laboral, la privacidad y la equidad. Asimismo, se identificó una brecha entre la velocidad de los avances tecnológicos y la capacidad de adaptación del marco normativo actual, evidenciando la necesidad de reformas legislativas que promovieran un equilibrio entre innovación y justicia social.
En conclusión, el estudio destacó que la integración tecnológica, si bien ofreció oportunidades para la modernización del sistema laboral, requirió un enfoque regulatorio que garantizara la dignidad, la igualdad y la sostenibilidad en las relaciones laborales.
This study addressed the impact of new technologies, particularly artificial intelligence, automation, and teleworking, in the field of Argentine labor law. Through a mixed methodological approach, the transformations in labor dynamics and their relationship with Economic, Social, Cultural, and Environmental Rights were investigated, as well as the normative and social implications derived from these changes. The non-experimental and cross-sectional design allowed for the combination of exhaustive literature review techniques, practical case analysis, and interviews with experts in the legal and technological fields. The results reflected that the adoption of these technologies not only redefined traditional labor relations but also posed significant challenges for the protection of workers' rights, especially in areas such as job stability, privacy, and equity. Additionally, a gap was identified between the speed of technological advances and the current regulatory framework's ability to adapt, highlighting the need for legislative reforms that promoted a balance between innovation and social justice. In conclusion, the study emphasized that technological integration, while offering opportunities for the modernization of the labor system, required a regulatory approach that ensured dignity, equality, and sustainability in labor relations.
