Derecho a la alimentación y función social de la propiedad en la problemática de agroquímicos de Argentina.

Abstract

En el presente trabajo de investigación se evaluó la suficiencia del marco normativo constitucional y legal argentino para garantizar el derecho a la alimentación adecuada vulnerado por el uso de agroquímicos y limitar el uso de estos a la luz de la función social de la propiedad. Para ello, se adoptó un enfoque cualitativo dogmático, basado en el análisis documental de normas, doctrina, jurisprudencia e informes de organismos internacionales. Se procedió a estudiar la recepción del derecho a la alimentación y la función social de la propiedad en cuerpos legislativos nacionales e internacionales, donde se halló la inclusión implícita de ambos en la Constitución Nacional Argentina, para después efectuar su análisis, crítica y relacionarlos con la problemática actual de alimentos fumigados con sustancias agroquímicas. Finalmente, se llegó a la conclusión de que el marco normativo constitucional y legal argentino es insuficiente a la hora de garantizar eficazmente el derecho a la alimentación y receptar la función social de la propiedad para limitar las fumigaciones de agroquímicos y su contaminación de los alimentos.

This research work evaluated the sufficiency of the Argentine constitutional and legal framework to guarantee the right to adequate food, which is violated by the use of agrochemicals, and to limit their use in light of the social function of property. To achieve this, a dogmatic qualitative approach was adopted, based on the documentary analysis of norms, doctrine, jurisprudence, and reports from international organizations. The study examined the reception of the right to food and the social function of property in national and international legislative bodies. Both were found to be implicitly included in the Argentine National Constitution. This was followed by their analysis, critique, and relation to the current problem of food contaminated with agrochemical substances. Finally, it was concluded that the Argentine constitutional and legal framework is insufficient to effectively guarantee the right to food and to incorporate the social function of property to limit agrochemical fumigations and their contamination of food.
