“Más allá de las estadísticas: Gestión judicial en violencia familiar y de género”

Abstract

El manuscrito analiza la implementación del Tribunal de Gestión Asociada (TGA) en el Fuero de Violencia Familiar y de Género de Córdoba, vigente desde mediados del 2024. Se problematiza cómo la lógica de eficiencia y productividad aplicada a este fuero impacta en la atención personalizada, el seguimiento de las causas y la protección real de las víctimas. Desde una mirada jurídica, se aborda el conflicto entre el funcionamiento fragmentado del sistema, la falta de unificación de criterios entre magistradas y la despersonalización del proceso judicial. Se articula una base conceptual con normativa nacional e internacional y aportes teóricos de diferentes autores, evidenciando los desafíos que enfrenta el derecho como ciencia blanda en contextos de alta vulnerabilidad. Finalmente, se advierte el riesgo de evaluar el desempeño del sistema judicial de violencia familiar con criterios propios de las ciencias duras —como la estadística y la productividad— sin considerar la complejidad humana, subjetiva y contextual que caracteriza a los conflictos que se abordan en este fuero.

This manuscript analyzes the implementation of the Associated Management Tribunal (TGA) in the Cordoba Court of Domestic and Gender Violence, effective since mid-2024. It questions how the logic of efficiency and productivity applied to this court impacts personalized care, case follow-up, and the effective protection of victims. From a legal perspective, it addresses the conflict between the fragmented functioning of the system, the lack of unified criteria among judges, and the depersonalization of the judicial process. It articulates a conceptual basis with national and international regulations and theoretical contributions from various authors, highlighting the challenges faced by law as a soft science in contexts of high vulnerability. Finally, it warns of the risk of evaluating the performance of the domestic violence judicial system with criteria from the hard sciences—such as statistics and productivity—without considering the human, subjective, and contextual complexity that characterizes the conflicts addressed in this court.
