Ausencia del Defensor del Niño en Salta frente a los estándares de protección internacional

Abstract

Este trabajo tuvo como objetivo analizar la ausencia de la figura del Defensor del Niño en el sistema normativo de la provincia de Salta, regulado por la Ley N.º 7970, y su adecuación a los estándares nacionales e internacionales de protección integral de derechos de niñas, niños y adolescentes. Se empleó una metodología cualitativa, centrada en el análisis documental de fuentes normativas, jurisprudenciales y doctrinarias. El estudio evidenció que la omisión de esta figura afecta el cumplimiento de obligaciones positivas del Estado argentino, particularmente en lo relativo al principio del interés superior y a la representación legal especializada. Los resultados revelan una tensión entre el derecho interno provincial y los compromisos asumidos por el país en tratados de derechos humanos con jerarquía constitucional. Se concluye que la ausencia del Defensor compromete la eficacia del sistema de protección integral, y se propone la necesidad de armonizar el ordenamiento local con el marco normativo federal e internacional.

This paper aimed to analyze the absence of the Child Advocate figure in the legal system of Salta Province, as regulated by Law 7970, and its compatibility with national and international standards for the comprehensive protection of the rights of children and adolescents. A qualitative methodology was used, focusing on documentary analysis of legal, jurisprudential, and doctrinal sources. The study showed that the omission of this figure affects the fulfillment of the Argentine State’s positive obligations, particularly regarding the best interests of the child and the right to specialized legal representation. The findings reveal a tension between provincial law and the commitments assumed by the country in human rights treaties with constitutional status. It is concluded that the absence of the Child Advocate undermines the effectiveness of the comprehensive protection system, and the need to harmonize local regulations with the federal and international legal framework is proposed.
