El procedimiento de investigación de la paternidad post mortem: ADN como prueba determinante de filiación

Abstract

RESUMEN En el siguiente trabajo de investigación, se desarrollará como tema central la filiación post mortem. Para llegar al punto de conflicto, antes se transitará por la evolución histórica del instituto de filiación, el sistema originario en nuestro ordenamiento jurídico, sus respectivas modificaciones, contenido y los efectos que produce, hasta llegar a la filiación post mortem. A sus efectos realizaremos un estudio exhaustivo de la misma, puntualizándonos mayoritariamente en la prueba biológica de ADN, considerando que es el examen más certero en cuanto a la determinación de la existencia del vínculo jurídico filial, debido a los grandes avances realizados por la ciencia. ABSTACT In the following work of investigation, the post-mortem filiation will develop as central topic. To come to the point of conflict, before one will pass along the historical evolution of the institute of filiation, the original system in our juridical classification, his respective modifications, content and the effects that it produces, up to coming to the post-mortem filiation. To his effects we will realize an exhaustive study of the same one, specifying for the most part in the biological test of DNA, considering that is the most accurate examination as for the determination of the existence of the juridical affiliated link, due to the big advances realized by the science.
