Resumen
La presente obra encuentra su razón en el debate suscitado en torno a las modificaciones propuestas a la ley penal juvenil, con especial asiento en la petición punitivista de reducir la edad mínima de responsabilidad penal de los 16 a los 13 años. Con base en el imperante tratamiento tutelar que cohabita en el proceso criminal para menores, se ha puesto como objetivo relevar la procedencia del argumento reduccionista desde una óptica constitucional y convencional, siempre tomando como referencia el ligamen supranacional que nuestra judicatura posee.
Sentadas estas metas, como producto de un trabajo enmarcado en la metodología de tipo descriptivo y un diseño no experimental enriquecido por la revisión de jurisprudencia, doctrina y legislación concerniente a esta franja etaria que oficia como muestra de este trabajo, se pone de vista que los resultados arrojan una descripción del Régimen Penal de Menores profundamente afligida por el exceso de ambigüedad y la falta de acondicionamiento del mismo. De igual importancia resultativa germen fundamentos constitucionales que se manifiestan de forma contraria a la iniciativa legislativa. Por todo lo expuesto es que se concluye que estas razones de improcedencia constitucional y convencional deben ser tomadas en cuenta por el tribunal al estar tratando con un proyecto de ley que no se ajusta a los estándares supranacionales.
This work is based on the debate on the proposed amendments to the juvenile criminal law, with special emphasis on the punitivist request to reduce the minimum age of criminal responsibility from 16 to 13 years old. Based on the prevailing tutelary treatment that cohabits in the criminal process for minors, the aim that has been set as an objective is to relieve the origin of the reductionist argument from a constitutional and conventional point of view, always taking as a reference the supranational link that our judiciary has. With these goals in mind, as a result of a descriptive methodology and a non-experimental design enriched by the review of jurisprudence, doctrine and legislation concerning this age group that serves as a sample of this work, it is clear that the results show a description of the Penal Regime for Minors deeply afflicted by the excess of ambiguity and the lack of conditioning of the same. Equally important is the germination of constitutional foundations that manifest themselves contrary to the legislative initiative. In view of the above, it is concluded that the initiative is not constitutionally, conventionally and supranationally appropriate.
