Las funciones del Defensor del Pueblo de la Provincia de Córdoba

Abstract

Resumen El objetivo de este trabajo es explicar cuáles son las deficiencias o debilidades de la ley 7.741 que le impiden al Defensor del Pueblo de la Provincia de Córdoba el eficaz desarrollo de sus funciones. El propósito de esta investigación es aclarar cuál es la legitimación con la que cuenta el Defensor del Pueblo para llevar a cabo las funciones asignadas por la ley. Para lograrlo se analizará la ley 7.741, y se brindará nuestra posición en cuanto a los aspectos positivos y negativos de esta norma. Como resultado de la investigación se ha llegado a la conclusión de que la ley 7.741 regula de una manera insuficiente la legitimación del Defensor del Pueblo, en cuanto sólo le otorga la posibilidad de proponer a las autoridades administrativas las soluciones que estime pertinentes, pero sin efecto vinculante.

Abstract The aim of this paper is to explain deficiencies or weaknesses of 7,741 law that prevent the Ombudsman of the Province of Córdoba effective performance of its functions are. The purpose of this research is to clarify the legitimacy with which the Ombudsman has to carry out the functions assigned by law. To achieve this we will analyze the law 7,741, and will give our position related to the positive and negative aspects of this rule. As a result of the investigation we conclude that the law 7,741 regulates insufficiently the legitimacy of the Ombudsman, as it only gives to the administrative authorities the possibility of proposing the solutions it considers appropriate, but without brinding effects.
