Resumen
El homicidio es considerado como uno de los mayores delitos cometidos contra la vida humana. Ahora bien, ¿se han preguntado qué sucede con los homicidios causados por adolescentes? ¿Qué factores influyen en el comportamiento criminal juvenil? ¿Qué es lo que motiva a este grupo etario en específico a cometer esta clase de delito? ¿Influye el entorno social o nacen siendo homicidas? ¿Existen patrones específicos en la planificación y ejecución de los homicidios cometidos por adolescentes? ¿Qué dice la ley penal? ¿De qué hablan las teorías criminológicas? Todas estas preguntas y más se abordarán en este informe: homicidios causados por adolescentes y su análisis en el comportamiento criminal de los mismos. Las teorías criminológicas sobre la delincuencia juvenil sugieren que la tensión, las actitudes favorables a la delincuencia y la influencia de la sociedad pueden ser factores que inciden en la comisión de delitos. Los factores de riesgo para los homicidios de adolescentes son diversos y pueden estar relacionados con la comunidad, la familia, la personalidad y el comportamiento. Factores de riesgo de personalidad y comportamiento como la agresividad física, ausencia de sentimientos de culpa, escaso desarrollo de las funciones ejecutivas, frialdad emocional, creencias que favorecen los actos violentos. La imputabilidad es la capacidad de una persona para entender que su conducta es antijurídica y actuar en consecuencia. En Argentina, los menores de 16 años no son imputables y no pueden ser juzgados penalmente por delitos. Los adolescentes de 16 a 18 años son punibles por delitos con penas mayores a dos años.
Homicide is considered one of the major crimes committed against human life. Now, have you ever wondered what happens with homicides caused by adolescents? What factors influence juvenile criminal behavior? What motivates this specific age group to commit this kind of heinous crime? Does the social environment influence or are they born homicidal? Are there specific patterns in the planning and execution of homicides committed by adolescents? What does the criminal law say? What do criminological theories talk about? All these questions and more are what I will address in this report: homicides caused by adolescents and their analysis in the criminal behavior of adolescents. Criminological theories on juvenile delinquency suggest that stress, delinquency-friendly attitudes, and societal influence may be factors in the commission of crime. Risk factors for adolescent homicide are diverse and may be related to community, family, personality, and behavior. Personality and behavioral risk factors such as physical aggressiveness, lack of guilt feelings, poor development of executive functions, emotional coldness, beliefs that favor violent acts. Imputability is the capacity of a person to understand that his or her conduct is unlawful and to act accordingly. In Argentina, minors under 16 years of age are not imputable and cannot be criminally prosecuted for crimes. Adolescents between 16 and 18 years of age are punishable for crimes with penalties of more than two years.
