Instructivo para la aplicación del “Protocolo para la identificación, recolección, preservación, procesamiento y presentación de evidencia digital” en la investigación penal de la provincia de Catamarca

Resumen
Una de las problemáticas a la que se enfrenta el Ministerio Público Fiscal de
Catamarca en la actualidad en cuanto a la investigación de nuevas modalidades delictivas desplegadas por los cibercriminales, es la rregularidad que acarrea el tratamiento de la evidencia digital en el proceso penal, debido a su falta de regulación en la provincia, ya sea a través de normativa legal o guías/protocolos que regulen la identificación, recolección, preservación, procesamiento y presentación de la evidencia digital. En ese aspecto, y en la mayoría de las investigaciones de delitos, se necesita obtener como medio probatorio, la evidencia digital que se encuentra almacenada en entornos digitales y dispositivos informáticos, y de ahí radica lo indispensable que se torna poder contar con normativa específica.
La propuesta del presente trabajo, es resolver esta problemática, lo que resultará de gran interés para el Ministerio Público, ya que en lo que respecta a la víctima, se ejercerá su tutela judicial efectiva, y en lo que respecta al imputado, permitirá respetar el debido proceso y demás garantías constitucionales de toda persona sometida a juicio. Para ello, se propondrá la creación, desde la Fiscalía General de la Provincia, de un Instructivo General para la aplicación del Protocolo para la identificación, recolección, preservación, procesamiento y presentación de evidencia digital, del Ministerio Público Fiscal de la Nación y del Ministerio de Seguridad de la Nación; para que este sea utilizado como criterio de actuación en el Proceso Penal de Catamarca, y como plus, la capacitación de todos los operadores del sistema, para su debida instrumentación.
One of the problems that the Catamarca Public Prosecutor's Office is currently facing in terms of the investigation of new criminal modalities deployed by cybercriminals, is the irregularity that entails the treatment of digital evidence in the criminal process, due to its lack of regulation in the province, either through legal regulations or guides/protocols that regulate the identification, collection, preservation, processing and presentation of digital evidence. In this regard, and in the majority of crime investigations, it is necessary to obtain, as a means of proof, the digital evidence that is stored in digital environments and computer devices, and that is why it is essential to have specific regulations. The proposal of this work is to resolve this problem, which will be of great interest to the Public Prosecutor's Office, since with regard to the victim, effective judicial protection will be exercised, and with regard to the accused, it will allow respect for the due process and other constitutional guarantees of every person subjected to trial. To this end, the creation, from the Attorney General's Office of the Province, of a General Instruction for the application of the Protocol for the identification, collection, preservation, processing and presentation of digital evidence, of the Public Prosecutor's Office of the Nation and the Ministry of National Security; so that this can be used as a criterion for action in the Catamarca Criminal Process, and as a bonus, the training of all system operators for its proper implementation.
