Su análisis y sus proyecciones en el derecho argentino.

Abstract

En la presente obra se desarrolló de manera integral el instituto de las pretensiones anticautelares y se abogó en pos de su aplicación en el Derecho Argentino. Para ello se puso de resalto la problemática del abuso cautelar, que justifica su aplicación. Luego de ello se expuso la regulación de institutos similares en otros ordenamientos jurídicos, puesto que los aciertos y errores de otros sistemas jurídicos deben ser utilizados para captar lo útil y modificar o eliminar lo impertinente. Asimismo, se analizó su concepto y su naturaleza jurídica (aun en desarrollo por p0arte de la Doctrina Argentina), sintetizando las posturas de los autores y una postura superadora. Además, se especificaron los distintos aspectos procesales a tener en cuenta para su aplicación. Hecho ello, entendiendo que todo instituto debe insertarse en un ordenamiento jurídico y ajustarse al mismo, se identificó y descartó la posible vulneración de derechos constitucionales que podría acarrear la aplicación de una medida anticautelar, se abogó por su aplicación a las distintas ramas del derecho y se analizó el reconocimiento actual en la jurisprudencia nacional. Y por último, se determinó la necesidad de su regulación y se plantearon problemas operativos que podrían surgir en la práctica, proponiendo una solución.

In this work, the institute of anti-cautionary claims was comprehensively developed and its application in Argentine Law was advocated. To this end, the problem of precautionary abuse was highlighted, which justifies its application. After that, the regulation of similar institutes in Comparative Law was explained, since the successes and errors of other legal systems must be used to capture what is useful and modify or eliminate what is impertinent. Likewise, its concept and legal nature (still under development by the Argentine Doctrine) were analyzed, synthesizing the positions of the authors and an overcoming position. In addition, the different procedural aspects to be taken into account for its application were specified. Once this was done, understanding that every institute must be inserted in a legal system and adjust to it, the possible violation of constitutional rights that could result from the application of an anti-cautionary measure was identified and ruled out, its application to the different branches of law was advocated and the current recognition in national jurisprudence was analyzed. And finally, the need for its regulation was determined and operational problems that could arise in practice were raised, proposing a solution.
