Resumen
La presente investigación buscó describir y explicitar las acciones gubernamentales tendientes al abordaje del análisis de la conducta criminal de personas que cometen filicidio, llevadas adelante por la Suprema Corte de Justicia de la Provincia de Buenos Aires. El alcance pretendido fue de tipo descriptivo-explicativo, con un enfoque cualitativo y un diseño no experimental transversal. La muestra elegida se construyó a partir de documentos, artículos académicos, libros, manuales, sentencias definitivas y otros recursos en los que se describen las acciones gubernamentales y diferentes temas relacionados con el filicidio. Esta selección se realizó mediante un muestreo no probabilístico intencional; asimismo, los instrumentos utilizados en la investigación fueron cualitativos.
Entre los hallazgos más significativos se logró identificar la ausencia de políticas públicas en materia de prevención, así como también la falta de una figura penal autónoma que contemple este delito. El análisis de las sentencias reveló el uso del artículo 80, inciso 1, del Código Penal para la tipificación de este, encuadrado como homicidio calificado por el vínculo. También se determinaron factores de riesgo en agresores, tales como trastorno límite de la personalidad, trastorno antisocial de la personalidad, explosión de violencia, hijo/a no deseado y embarazo no deseado.
Los resultados obtenidos en esta investigación ponen de manifiesto la complejidad de este fenómeno y la necesidad de un enfoque interdisciplinario que incluya intervenciones jurídicas, de salud mental, medidas preventivas, seguimiento y redes de apoyo para garantizar una respuesta más efectiva. La falta de información representa una dificultad para poder abordar y analizar el filicidio de una manera integral.
This research sought to describe and explain the government actions carried out by the Supreme Court of Justice of the Province of Buenos Aires to address the analysis of the criminal conduct of individuals who commit filicide. The intended scope was descriptive and explanatory, with a qualitative approach and a non-experimental cross-sectional design. The sample was constructed from documents, academic articles, books, manuals, final judgments, and other resources that describe government actions and various topics related to filicide. This selection was made through purposive non-probability sampling; the research instruments used were qualitative. Among the most significant findings were the absence of public policies regarding prevention, as well as the lack of an autonomous criminal law that addresses this crime. The analysis of the judgments revealed the use of Article 80, paragraph 1, of the Penal Code to classify this crime, categorized as aggravated homicide by connection. Risk factors were also identified in offenders, such as borderline personality disorder, antisocial personality disorder, violent outbursts, unwanted children, and unwanted pregnancy. The results of this research highlight the complexity of this phenomenon and the need for an interdisciplinary approach that includes legal and mental health interventions, preventive measures, follow-up, and support networks to ensure a more effective response. The lack of information represents a challenge for comprehensively addressing and analyzing filicide.
