Abordaje del Comportamiento Criminal a través de la difusión de imágenes no consentidas de las víctimas en medios digitales en la Provincia de Córdoba: Sexting

Abstract

El presente trabajo examina la necesidad de generar un análisis criminal y proponer estrategias de prevención de la conducta innovadora de sexting que se ve atravesada por la dificultad que presenta la sociedad y el Estado para abordar a quienes son autores de este tipo de conductas. Así, la importancia de diferenciar las conductas que prevé esta modalidad nueva de difusión de imágenes no consentidas conocidas como sexting primario y sexting secundario. El objetivo de este estudio consistió en describir esta conducta, el uso incorrecto de las TIC (Tecnología de la Información y Comunicación) y explicitar las acciones del Estado y el Tribunal Superior de Justicia de la Provincia de Córdoba, tendientes al abordaje del análisis de la conducta criminal y su indagación sobre los tratamientos para mitigar las consecuencias para las víctimas. En referencia a los métodos, la investigación utilizó un muestreo no probabilístico con enfoque cualitativo, con un alcance descriptivo de tipo no experimental y transversal. Los resultados evidenciaron una escasez de protocolos por parte del TSJ de la provincia de Córdoba y tratamientos para un abordaje integral eficaz para las víctimas. El rol del criminólogo es de suma importancia ya que, al momento de entender el porqué de esta conducta y actuar en consecuencia, interviniendo en aquellas decisiones políticas vinculadas a la criminalidad.This paper examines the need to generate a criminal analysis and propose prevention strategies for the innovative behavior of sexting, which is hindered by the difficulty society and the state face in addressing those who engage in this type of behavior. Thus, it is important to differentiate the behaviors envisaged by this new form of dissemination of non-consensual images, known as primary sexting and secondary sexting. The objective of this study was to describe this behavior, the misuse of ICTs (Information and Communication Technologies), and to explain the actions of the State and the Superior Court of Justice of the Province of Córdoba, aimed at addressing the analysis of criminal behavior and investigating treatments to mitigate the consequences for victims. Regarding methods, the research used non-probability sampling with a qualitative approach, with a descriptive, non-experimental, and cross-sectional scope. The results revealed a lack of protocols by the Supreme Court of Justice of the Province of Córdoba and treatments for an effective comprehensive approach for victims. The role of the criminologist is of utmost importance, as it helps to understand the reasons for this behavior and act accordingly by intervening in policy decisions related to crime.
