El comienzo de la existencia de la Persona Humana en el Código. Civil y Comercial. Interpretación Constitucional y Convencional

Abstract

Para poder analizar jurídicamente el comienzo de la existencia de la persona humana, el Derecho se basa en las distintas teorías de las ciencias biológicas. Con los avances de la ciencia, se logró fecundar óvulos fuera del seno materno y el derecho argentino no había previsto ningún régimen de protección del embrión aparte del delito de aborto que tipifica el Código Penal. En el año 2002 la Corte Suprema de Justicia de la Nación modifica la interpretación del término “concepción”. Entonces ¿Existe un criterio claro a los fines de poder establecer cuando se produce el comienzo de la existencia de la persona humana de acuerdo a la legislación argentina actual, teniendo en cuenta lo establecido por la Constitución Nacional, los tratados internacionales y la jurisprudencia existente en la temática? La reforma del Código Civil de 2015 reanudó esta controversia incorporando un rol protagónico a la voluntad procreacional y al consentimiento como sujetos y objeto de estudio para un nuevo tipo filiatorio derivado de las técnicas de reproducción asistida algo que enmarcará la interpretación de los tribunales locales toda vez que existan controversias derivadas del comienzo de la persona humana siempre a la luz de nuestra Constitución Nacional y de los Tratados de Derechos Humanos que la Carta Magna ha incorporado.

In order to be able to analyze legally the beginning of the existence of the human person, the Law is based on the different theories of the biological sciences. With advances in science, it was possible to fertilize ovules outside the mother's womb and Argentine law had not foreseen any embryo protection regime apart from the crime of abortion that typifies the Penal Code. In 2002, the Supreme Court of Justice of the Nation modified the interpretation of the term Conception. So when does the beginning of the existence of the human person take place according to the current Argentine legislation, taking into account the provisions of the National Constitution, international treaties and the existing jurisprudence on the subject? The reform of the Civil Code of 2015 resumed this controversy incorporating a leading role to the procreational will and consent as subjects and object of study for a new filiatorial type derived from the techniques of assisted reproduction something that will frame the interpretation of the local courts every time that there are controversies arising from the beginning of the human person always in light of our National Constitution and the Human Rights Treaties that the Constitution has incorporated.
