Repositorio Institucional; Argentina.Altavilla, Cristian2025-11-112025-11-112024-12https://repositorio.21.edu.ar/handle/ues21/29623El presente trabajo se plantea indagar acerca del nacimiento y la evolución de tres conceptos clave del sistema interamericano de derechos humanos: Democracia, Estado de Derecho y Derechos Humanos, conceptos que en la jurisprudencia de la Corte Interamericana de Derechos Humanos y de gran parte de la doctrina, se encuentran interconectados dentro del esquema del sistema interamericano de derechos humanos; sin embargo, estos tres conceptos no se derivan lógicamente uno de otros, sino que esta intervinculación sólo puede darse a través de un esfuerzo interpretativo que, además, requiere de la acción concreta de los Estados para que tengan vigencia efectiva. En esta tarea, el trabajo se propone revisar los contenidos teóricos y normativos de estos tres conceptos, con especial hincapié en los intentos por normativizarlos a través de instrumentos internacionales.This paper sets out to investigate the birth and evolution of three key concepts of the Inter-American human rights system: democracy, rule of law, and human rights—concepts that, in the jurisprudence of the Inter-American Court of Human Rights and much of the legal doctrine, are interconnected within the scheme of the Inter-American human rights system. However, these three concepts are not logically derived from each other; rather, this interlinkage can only occur through an interpretative effort that, in addition, requires the concrete action of the States to have effective validity.
